Police Brutality in SJ
I saw it on the news but couldn't make out anything cus it was too dark. A friend showed me the video on youtube and it was much clearer. You can clearly see the police beating the guy with a baton even though he's already on the ground.
I hate to pass judgment but the video looks pretty clear. I'm sure there will be an uproar about this soon enough. |

My principal in high school was and still is a SJPD. Clearly police brutality.

I agree that is police brutality, barring the slim chance that the guy had a gun or something you couldn't see in the video. Disgusting, those cops should serve jail time for that.

everything past about 45 seconds I would say is. Though I am not advocating it, the problem with calling the first half is that the person may well be clearly on the ground, but he is pushing away at the cops whereas if he just listened and put his goddamn hands behind his back who knows if any of this would have happened. Also, have to wonder what happened before that point, who knows what he may or may not have done to the cops, he may well have pulled a weapon on them before tape starts. Yet again not advocating, but too hard to tell without a full story.

EDIT: These guys are on paid leave right now. It also sounds like they may have given the kid a shot or two with the baton AFTER he was in handcuffs. If that's teh case not only do these piggies need to go to jail, they need "COP" tattooed on their foreheads so the other inmates can easily identify them. Then they can see how fun it is to be ganged up on

Not only that, but if you're being beaten, your first reaction is going to be to try to crawl away - he wasn't going anywhere, there was no need to continue to use the baton.
Like a previous poster said - we do not have all the facts here, but based on just this video I'd say they went overboard.

I'm not passing judgement, but the guy is clearly not "rolling over" and just crying/yelling back at the police.
Problem is that it looks to be fair game. You don't listen, they are allowed to use force. How much force is left to be determined by a court.

from the news story, it seems like they went way overboard with this guy. It started with a stupid prank that his roommate put a piece of bar soap on this guy's dinner. Then, this guy said something to the effect that "I would have killed you if we were in 'Nam". The roommate then called the cop on this kid......
I'd say, "What an eff-ing douche bag the roommate is?"

While I do not advocate excessive force on any level in my profession, there is no way any of you can make an educated decision about the actions of those officers from that poor quality video. Many people believe that what they can see in those videos is the whole story, but by the time most videos are taken, a litany of offenses against officers have occurred. There is NO excuse for force beyond placing a suspect in custody or gaining compliance, and the law is very clear on that issue. Administrative leave is common when investigating any type of significant force issue, and it is designed to allow internal inquiries to run their coures until officers are exonerated or found culpable. If they are at fault, there are disciplinary procedures and criminal or civil liability to deal with. The video cannot possibly show us all of the facts. Please do not be so quick to judge or condemn the people who are here when you really need them, but are despised when you don't.

He was fired after refusing to cooperate with the internal investigation. Civil action is pending, i'm sure.

I agree with those that said something along the line of "don't pass judgment until there is clear evidence." I completely understand that we cannot come to a decision before presented with all the facts. However, most people are not able to calm down and think things through when they are in a scared state. It's similar to how one person cannot think clearly when he/she goes dipping in an icy cold bath. When you're in that kind of state it's very difficult to think straight. I'm sure as the days go on there will be an uproar about this if it is deemed that the police were in face too brutal.
