damaged by body shop, what to do?

hi guys i need your help.
so i sent my car to this body shop in SoCal for a small dent repair in the rear bumper, the shop fixed the rear bumper but when i got my car back it was missing the front lip, apparently one of their drivers was driving my car like an idiot and broke the front lip, now they told me they would replace it or send me a check for the new lip. now i have been calling them for 2 days and they havent ordered the lip or decided to send me a check. they havent been answering my calls they are avoiding me, now i have everything on video from my dash cam, so my questions is, how can i get my money for the repair? do i have to file a claim with my car insurance? get a lawyer or what? thanks guys

write them a demand letter
put a reasonable time deadline
say ... 10 days from date of letter
pay money or you will file a lawsuit

if they don't pay, you file a small claim by yourself without a lawyer

you may choose to go through your insurance if you have comprehensive
they may cover it, and they will get their money back from the shop
however, it may affect your insurance premium
you should ask your insurance company about it

It shouldn't affect his premium if the shop is at fault, and if it does then he needs to get a new insurer. Part of doing business (legitimately) is getting a license and insurance. The shop would have to pay for the repairs or his insurer can take it up with their insurer after the fact.

the shop told me they ordered a replacement part already and that they would call me when it arrives so they can install it, so we'll see...thnx for the replies guys
