Question about Speeding ticket

Ok so my court date is on the 16 of this month, thought it was 13th, but anyways. Just wanting to know, if I want to fight it, do I have to notify them before the due date of the bail amount, or do I just show up on the date?

by this month, do you mean april? it's still march btw....

nope...you will show up...plead not guilty...and that's it..they will then set a pre-trial date...that is when you (and maybe your lawyer) will meet with the prosecutor...then depending on the outcome of that meeting...either he will dismiss (unlikely), you will plead to a lesser charge, or schedule a trial...

my suggestion is to NOT WAIVE your speedy trial rights and hope that the court will screw up and miss the deadline for your trial...

Oh ok, and when you mean not waive my trial rights you mean not pay it?

Oh and another thing, would it be wise to mention that there was no way the cop used radar seeing that my v1 never went off once, and that the area he got me in was coming around the corner, and if i remember right, radar cant go around corners?

Put simply:

You go to court.

You plead Not Guilty.

They set a court date.

You show up for court and plead your case.



You are innocent until proven guilty (or plead guilty), and don't pay anything until then. Some states may have a pre-trial that ideliver mentioned. I don't know what the court system does in SoCal.

I thought it was:

1. Submit the "Trial by Declaration" in hopes that there there is no contest from the officer (or the court rules in your favor - rare).

2. If fail, submit a "Request for New Trial".

3. For me, request a change of venue (making it less likely the officer will attend).

4. Hope that the matter is dropped or the officer doesn't show up.

5. Research and prepare for the trial (will most likely not get to this point).

You do have to pay the bail amount, but that is returned once the matter is dismisssed. And you don't have to go to court until step #4.
