In other news, I have to work the DUI checkpoint Friday night. I'm hoping we take a bunch of impaired drivers off of the road that night. We'll even have a few units hidden on side streets to catch the runners. It's going to be a good time.

An INFRACTION doesn't make one a criminal. Jay walking, however common, still gives an officer probable cause to detain should he/she desire to. Sometimes it leads to nothing, and sometimes it's a bad person jay walking and we get a stat for that arrest. Yay for us!

You don’t get it, Murf. You’re a law abiding citizen. A cop sees a beer cap in Your car. You are clean, you’re on your way. What about the asshole that has open warrants, a weapon, drugs, whatever. That cap just got a bad guy off the street.

See thats another one. Folks drink on their property all the time, hell keggers in the county. We need private property laws back. ie I have to wait for a criminal to actually touch down in my house to shoot him....whats the saying, make sure they fall in, not out.

Or someone breaking and entering or destroying my car...society says..awww poor criminal you have insurance. We should be able to protect OUR private property the same way police protect their precinct.

It was many years ago when an obscure law came to light here in NS. A guy was arrested for buying a used firearm at a flea market. That in itself doesn't seem too out of place, except that it turned out that it was illegal to buy a firearm at a flea market but there was no law against selling a firearm at a flea market. It seems to me that the lawmakers messed that one up.

The cap itself doesn't constitute an open container, but the cap coupled with other articulable facts can get you in. The bed of the pick-up wouldn't really apply.

There's no expectation of privacy outside of your front door. Curtilage laws apply in some cases, but cops typically use the "mailman rule/principle." If the mailman can access it, it's reasonable to believe - and the courts affirm - that you, as the homeowner, have no expectation of privacy in that/those areas.

Onto the drinking....


....city ordinances prohibit drinking in public; that would include your front lawn. With that said, would I typically run up on someone and detain because they are drinking on their porch? No! If I have another lawful reason to be there (...e.g. a call for service), I might cite for it if the person is being an ass.

You don't get it. A cop sees a beer cap (or a seed), and he runs my name, * Murphy. A million outstanding warrants come up for * Murphy (ask me how I know). Not for me, but I'm then guilty until proven innocent.

No dillweed! Name alone doesn't make you guilty. If a person's name and DOB match, then we're onto something. I will then pull them up in Cal-Photo to verify. If they've never been issued a California ID/DL, then they're going to the house to get printed.
