Sometimes high and sometimes low. No, it didn't really matter because the main charge, 23152(a) CVC still applied. It was the 23152(b) CVC charge (…greater than the admin per se .08 limit) that was sometimes affected…..e.g. .07 vs. .09. There were times I estimated high - .14 vs the real BAC .12 - but it didn't matter because either way, both sections applied.

I remember a Mythbusters test for drunk vs distracted driving where they smeared peanut butter on the steering wheel and all kinds of other craziness to compare it to drunk driving...don't remember the outcome though.

Wouldn't mind being a test dummy for a wet lab in the bay area sometime. I've participated in mock jury selection classes and stuff for some friends in law school, stuff like that is kinda entertaining to me. See how much of a monkey wrench I can throw into their training, either overtly or subtly.

One of the jury classes I just started a monologue and meandered all over the place after a simple question, didn't let a student get a word in, started asking other jurors questions...professor eventually stopped me but was like "perfect example of how someone may not be aggressive, obnoxious, etc but can still get out of control and demonstrate why you need to be curt, concise, and in control at all times."

If I remember correctly for that one, the student had like 5 minutes to question 30 of us and I was the only one she got a chance to ask anything of.

A wet lab will tell you A LOT about how your real tolerance and ability differs from your perceived tolerance and ability.

For example….


….if you can barely find your nose during the Finger to Nose test or can't walk a straight line during the Walk & Turn test…….two things you could easily do right now, assuming you're currently sober, it says a lot. If you can barely find your nose, how are you in a suitable condition to process everything it takes to operate a motor vehicle with the safety, care and concern of a sober person?!?

Nystagmus is a sign of significant neurological impairment, and with that alone I can predict impairment within .02% BAC.

Back on the 4th of July, I performed the psychophysical SFST tests on inebriated persons at the pool. They were shocked by their level of impairment.

I appreciate that. I really try to learn as I teach/share experiences……and teach/share experiences as I learn from others. I think the biggest disconnect between law enforcement and some segments of the public is a lack of conversation/communication. I think bridging 50% of that gap could be accomplished simply by opening a forum and both sides being willing to listen. I blame the media for a lot of the influence though. Their intention(s) aren't usually for the sake of the greater good.
