Yeah this is correct. Even a public defender could get the case tossed out with illegal surveillance, wiretaps, et all. Perfect example is, they just issued a warrant. The reason they're stating is - wire fraud. Someone (presumably Brian) took money out of Gabby's capital one card AFTER the date of her death listed on the autopsy report. Warrants not for murder, it's wire fraud. Because they can't prove he murdered her. They (FBI) even illustrate that when they issued the arrest notice. This is to buy them time while they continue to investigate the death. They're using the loophole to arrest and keep him detained until they can pin the murder on him.
