If you just brought it in for an oil change or routine maintenance and it wasn't hooked up it would be fine, and if you flashed it back to stock before any warranty work you'd presumably also be fine...but it's still a risk regardless. There's no 100% guarantee that they wouldn't be able to detect that you've modified the DME. If you're not comfortable risking your warranty don't flash the car. Plain and simple.
Some bootmod3 features that make detection more difficult.

- Revert back to Stock and locked. No chance of tamper code showing once flashed back.
- No flash counter limitations - our dev cars have been flashed well over 1000 times. This has always been a BM3 feature.
- Flash date freeze - unique BM3-first feature, no other tool supports today. Flash date never changes when flashing with BM3.
- Flash counter freezes after OBD unlock

But if BMW wants to dig hard enough they can find anything. It would just take a lot more effort.

Looks like Steve Dinan will have a stage 1 flash with factory matching warranty. For individuals that want too worry less and not deal with removing tune for service.
