I am not a crash test expert but anyone think it's the "Tubular Side Airbags" instead of the "Side Curtains" that's causing the poor results in both the 5 series and E93?

We see that the "Side Curtain" airbags are found in almost all if not all recent vehicles equipped with side airbags. The tubular side airbags are the first generation head protection side airbags offered first by the E39 5 series back in 1998. So I think it's safe to say that side curtains offer better performance than the tubular airbags.

The E90's are now equipped with Side Curtains and it did score well on the IIHS crash tests.
